DJ Charmza’s “Jerusalema” Legal Battle Heads to Trial Amid Personal Tragedy

The long-running legal dispute between DJ Charmza (Ntimela Chauke) and DJ Master KG (Kgoagelo Moagi) over the ownership of the global hit song Jerusalema is set to finally go to trial.

The case, which has drawn significant public attention, has been ongoing for five years, with Charmza claiming rightful royalties from the 2020 track.

Despite his key involvement in the song, Charmza has not received any recognition or compensation for his contribution.

Representing Charmza and co-defendant Presley Ledwaba (Biblos) is Stephen Hollis from Adams & Adams, who is taking on the case pro bono.

Hollis, alongside his partner Thando Manentsa, has expressed confidence in the strength of the case, noting that it highlights deep-rooted issues in South Africa’s music industry.

“This case is about more than just copyright infringement,” Hollis said.

“It addresses a systemic problem where vulnerable artists are exploited, stripped of their intellectual property rights, and denied their due recognition and profits.”

Hollis believes that a successful verdict could restore justice in an industry plagued by such infringements.

He added that many artists, particularly those without the financial means, often struggle to access legal support, leaving them at the mercy of unscrupulous industry figures.

The trial is scheduled to take place in the Pretoria High Court from November 17-28.

The delay in bringing the case to trial has been attributed to tactics used by the defense to stall proceedings.

Hollis criticized these attempts, asserting that they were designed to exhaust the plaintiffs’ resources and force them to withdraw.

“We will ensure our clients have their day in court, no matter the delays,” he vowed.

Meanwhile, fellow Jerusalema artist Nomcebo Zikode, who has been embroiled in her own legal battle with Open Mic Productions, the company behind the song, has remained largely silent on the matter.

She stated she is still awaiting her day in court and hopes for justice regarding unpaid royalties.

The case takes on an even more tragic dimension as DJ Charmza has been forced into hiding following the fatal shooting of his brother, Jimmy Chauke, who was mistaken for him by assailants.

The incident occurred during a robbery at his father’s home in Limpopo, where Charmza’s brother was killed and his father injured.

Charmza believes the attack may be linked to his ongoing legal battle over Jerusalema. “I can’t even attend my brother’s funeral because I know I will be killed,” he revealed.

Fearing for his life, the DJ is currently in hiding, unsure of who may be behind the threat.

The police have confirmed the case is under investigation, while Charmza continues to fight for justice, both in the courtroom and for his own safety.
